Kuumba
Terms of Service
Effective October 22, 2026
These terms cover your account, the visuals you create, and the credits used to run Kuumba.
1. Agreement
These Terms of Service are a contract between you and the operator of Kuumba (“Kuumba”, “we”, “us”) for the website, apps, and related services at kuumba.ai. By creating an account, signing in, or using the service, you agree to these terms and to the Privacy Policy.
If you use Kuumba for an organization, you confirm that you can bind that organization, and “you” includes it.
2. The service
Kuumba is a design workspace for fashion and commerce visuals. Depending on your plan, it includes a canvas, pattern and motif tools, mockups, directed image edits, bulk generation, fashion looks and virtual try-on, short product video, workflows, brand kits, and inspiration templates.
Many results are produced by AI from your prompts, uploads, and settings. Outputs can vary. We may add, change, or retire features, and we may set fair-use or rate limits so the service stays reliable.
3. Accounts
You need an account to use the workspace. You can register with an email and password, or with Google when that option is available. You must provide a working email and keep your login details confidential. You are responsible for activity under your account.
You must be at least 16 years old, and able to form a contract, to use Kuumba. The service is a professional design tool and is not directed at children.
4. Credits and plans
Some tools consume credits. Image tools are billed per output image. Other tools, including video, may be billed by duration or by unit. The amount that applies is the one shown in the product when you run the tool, and each successful charge is listed in your credit history.
We check that your balance covers a billed run before it starts, and we deduct credits when the run succeeds. A run that fails before a result is delivered is not meant to be charged. New accounts may receive a starter balance. Starter and promotional credits have no cash value.
Credits are a limited license to use the service. They are not money, they are not transferable, and they are not redeemable for cash. Paid plans, when offered, are billed on the terms presented when you or your organization subscribe. If your workspace is on a plan arranged for a team, billing is handled with that plan’s administrator. We may change future credit rates; the rate in effect is the one shown at the time you run the tool. Amounts already charged stay as recorded in your history.
5. Your content
You keep your rights in the prompts, photos, logos, brand materials, and other content you submit (“Your Content”), and in the outputs we generate for you from it, subject to third-party rights and these terms.
You grant Kuumba a non-exclusive license to host, reproduce, display, and process Your Content and the resulting outputs only as needed to operate the service: to run the tool you asked for, to keep projects and history, to show them back to you, and to secure and troubleshoot the product. This license ends when the content is deleted from the service, except for copies we must keep for security, legal, or billing records.
You confirm that you have the rights needed for what you upload and for how you use the results. That includes product photos, trademarks, and the likeness of any real person. You are responsible for reviewing outputs before you publish or sell them.
6. AI output
AI output can be incomplete, inaccurate, or similar to other works. Kuumba does not guarantee that an output is original, non-infringing, legally compliant, or fit for a particular listing, ad, or product claim. Do not present a generated person as a real, identifiable individual unless you have the right to do so. Do not rely on generated text for factual product claims without checking it.
We may refuse or remove a generation that we reasonably believe violates these terms or the law.
7. Acceptable use
You may not use Kuumba to:
- break the law, or infringe copyright, trademark, privacy, or publicity rights;
- create or share sexual content involving anyone under 18;
- create non-consensual intimate imagery, or impersonate someone in order to mislead or defraud;
- upload malware, probe or disrupt the service, or access accounts and data that are not yours;
- resell access to the service, or systematically extract outputs to train a competing model, without our written permission.
Commercial use of your own product visuals, catalog images, and campaign assets is allowed. The inspiration library, interface, and templates remain ours; applying a template gives you the resulting image, not ownership of the template itself.
8. Our intellectual property
Kuumba, the product design, software, inspiration cases, and our trademarks belong to us or our licensors. These terms do not transfer that ownership. You may not copy the service, reverse engineer it except where the law allows, or use our name in a way that suggests we endorse your products.
9. Availability
The service is provided on an “as available” basis. Generation can be delayed or fail, and stored files can be lost in a failure despite our efforts. Keep your own copies of work you need to retain. We may suspend the service for maintenance, security, or legal reasons.
10. Ending access
You may stop using Kuumba at any time and may ask us to close your account. We may suspend or close an account that violates these terms, creates risk for other users, or is unused where we have given notice. On closure, your license to use the service ends. Sections that by their nature should survive, including intellectual property, disclaimers, and liability limits, continue to apply.
11. Disclaimers
Except where the law does not allow a disclaimer, the service is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and without a warranty that outputs will meet a marketplace’s rules or that the service will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent the law allows, Kuumba and its operators, staff, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill. Our total liability arising out of the service in any 12-month period is limited to the greater of the amount you paid us for Kuumba in that period or 100 US dollars.
These limits do not apply where the law forbids them, including liability for fraud or for death or personal injury caused by negligence.
13. Indemnity
You will indemnify Kuumba and its operators against claims, damages, and reasonable legal costs arising from Your Content, your use of outputs, or your breach of these terms, except to the extent the claim is caused by our own breach or willful misconduct.
14. Law and disputes
These terms are governed by the laws of the jurisdiction where the operator of Kuumba has its principal place of business, without regard to conflict-of-law rules. Courts in that place have exclusive jurisdiction, except that either party may seek injunctive relief for misuse of intellectual property or unauthorized access to the service. Nothing in these terms limits rights you have as a consumer that cannot be waived.
15. Changes and contact
We may update these terms. The effective date at the top of this page will change when we do. If a change is material, we will provide notice in the product or by email when we have a reasonable way to reach you. Continuing to use Kuumba after the update takes effect means you accept the updated terms.
